Trademark Renewal

Keeping a registered mark active by filing the renewal application before the ten-year term ends, or restoring a mark that has lapsed within the grace period the Registry allows.

Quick answer

A registered trademark must be renewed every ten years from the date of registration by filing Form TM-R along with the prescribed fee. The application can be filed up to one year before expiry, and the Registry also allows a six-month grace period after expiry for a surcharged renewal. If the mark is removed for non-renewal, restoration can still be sought within one year of removal, subject to the Registrar's discretion.

Why choose us

Why renewals should not be left to the last minute

What sets our approach apart.

A lapsed mark can be picked up by someone else

Once removed from the Register, the mark becomes available for a fresh application by a third party.

Restoration is not guaranteed

Restoration of a removed mark is at the Registrar's discretion and is not automatic once the window has passed.

Renewal is also a chance to review the portfolio

Renewal time is a natural point to check whether the classes filed still match how the mark is actually being used.
