What is a Trademark?

A trademark is a sign, word, logo, name, slogan or combination that distinguishes the goods or services of one business from those of others. In India, trademarks are governed by the Trade Marks Act, 1999 and administered by the Registrar of Trade Marks under the office of the CGPDTM.

Registering a trademark gives you exclusive rights to use the mark, the ability to take legal action against infringers, and a valuable brand asset. The trademark registration process moves through search, filing, examination, publication and grant, and a registration lasts ten years before renewal.

What is a trademark and why is it important?

What is the difference between the TM and R symbols?

The TM symbol can be used once you have applied for or are claiming rights in a mark, while the R symbol can be used only after the mark is registered. Using R on an unregistered mark is not permitted.

What are trademark classes?

Goods and services are divided into 45 classes under the international classification. You register a trademark in the classes that cover your actual or intended business, and you can file in more than one class.

How long does a trademark last in India?

A registered trademark in India is valid for ten years from the date of application and can be renewed indefinitely for further periods of ten years each, so long as renewals are filed on time.

Can I register a logo and a name together?

You can register a name and a logo as a single combined mark, or protect them separately as a word mark and a device mark. Filing them separately often gives broader and more flexible protection.

Do I need a registered company to apply for a trademark?

No. Individuals, proprietorships, partnerships, LLPs and companies can all apply for a trademark. Many founders register the trademark alongside incorporating their company or LLP.
